Bear Mountain PKWY Speeding Leads to DWI Arrest

State Police announce the arrest of Jose R. Lopez, 23 years old, of Cortlandt, New York, for Driving While Intoxicated with a previous conviction, a Class E Felony.
 
Troopers stopped Lopez after they observed him speeding on the Bear Mountain Parkway at 4:08 a.m. April 6.
 
Police said Lopez provided an ample breath sample that yielded a Blood Alcohol Content of .10% and was issued Uniform Traffic Tickets ordering him to appear before the Town of Cortlandt Court on April 21, 2014.

.10 was legal limit for many years. "Intoxicated" seems a stretch.

I own a 'professional'/ police grade breathalyzer and let me just say... I've thought myself as pretty tipsy, thinking I would blow over the limit and would be too impaired to drive.. when in fact I've only blown a .06..... a .10 is most def drunk. except spare the aged drinker who prob barely feels it but its scary to think that .08 is our limit when it could actually be lowered.
