Police investigating a leaving the scene of a car accident report led to the arrest of a 40-year-old Mohegan Lake man, who allegedly drove drunk while his 10-year-child was in the vehicle.
Edras Joel Rivas Duarte faces a number of charges after his July 14 arrest in Yorktown at about 10:47 p.m.
He was charged with driving while intoxicated, driving with a blood alcohol content of .08 percent or more, misdemeanors; aggravated DWI (operation with a child), a "Leandra's Law" violation class E felony. Duarte was also charged with leaving the scene of a property damage accident and failure to notify DMV of address change, traffic infractions.
The vehicle accident occurred at 3436 Lexington Ave. on Saturday, police said, when the man allegedly left the scene. Police said the defendant allegedly drove drunk while his 10-year-old child was in the car with him.
Duarte was arrested near his residence and transported to police headquarters for processing where he was additionally charged with allegedly having a Blood Alcohol Content of .08 percent or more.
The man was later released on $250 bail and is scheduled to appear in on Aug. 16.
